Terms and Conditions of Use – SACRATISSIMUM e-store

Welcome to sacratissimum.com (the "Website" or "Store"), that integrates an e-commerce platform operated by Sacratissimum Christus Societas (hereinafter "we", "us", "our", or "SACRATISSIMUM").
These Terms and Conditions ("Terms") govern your access to and use of the Website, including browsing, purchasing products or services ("Products"), and any related interactions. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Website and make purchases. By using the Website, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
2. Products and Orders
2.1. All Products offered are sourced from and fulfilled by independent third-party suppliers, manufacturers, wholesalers, or fulfillment partners ("Suppliers"). We act solely as a retailer/reseller and do not manufacture, store, inspect, or physically handle the Products. Descriptions, specifications, images, and availability information are provided based on data supplied by our Suppliers and are for informational purposes only.
2.2. We make reasonable efforts to ensure the accuracy of Product information displayed on the Website. However, we do not warrant or guarantee the accuracy, completeness, reliability, or current availability of any Product description, image, pricing, or other information, as such information originates from third-party Suppliers.
2.3. All orders are subject to acceptance by us and confirmation of availability by our Suppliers. We may refuse, cancel, or not fulfill any order (even after confirmation or payment) if a Supplier cannot or will not fulfill it, for any reason, including stock unavailability, pricing discrepancies, quality concerns, or compliance issues. In such cases, we will refund any amounts already paid (excluding any non-refundable transaction fees), and you agree that this shall be your sole remedy.
2.4. We are not responsible or liable for any acts, omissions, representations, warranties, breaches, negligence, or misconduct of any Supplier. Any issues related to Product quality, authenticity, conformity, defects, safety, packaging, labeling, or compliance with laws shall be addressed directly with the Supplier where possible, subject always to your statutory rights (if applicable).
2.5. Prices are in USD and include applicable tax where we are required to charge it. Shipping costs (if applicable), customs duties, import taxes, brokerage fees, and any other charges are your responsibility and will be displayed before checkout when and where feasible (estimates only).
3. Shipping, Delivery & Returns
3.1. All shipping, packaging, and delivery are performed exclusively by third-party Suppliers and/or carriers selected by them. We do not control shipping methods, carriers, routes, or timing.
3.2. Delivery times are estimates provided by Suppliers and are not guaranteed. We are not responsible or liable for any delays, non-delivery, lost packages, damage during transit, customs holds, incorrect addresses provided by you, or any other shipping-related issues. Risk of loss or damage passes to you upon handover of the Product by the Supplier to the carrier (typically under Incoterms 2020 – EXW, FCA, or similar).
3.3. We disclaim any liability for the acts or omissions of carriers, customs authorities, or any other third parties involved in fulfillment or delivery.
3.4. Right of Withdrawal (Cooling-off Period).
If you are a consumer located in the European Union (or where similar statutory rights apply): You have the right to withdraw from the purchase contract within 14 calendar days without giving any reason. The withdrawal period expires 14 days after the day you (or a third party indicated by you) acquire physical possession of the goods (or the last good in a multiple-order delivery).
To exercise the right of withdrawal, inform us (preferably by email to store@sacratissimum.com) of your decision before the period expires. You may use the model withdrawal form below, but it is not obligatory.
Effects of withdrawal: We will reimburse all payments received from you (excluding supplementary shipping costs if you chose a non-standard delivery) within 14 days of receiving your withdrawal notice. Reimbursement will use the same payment method unless expressly agreed otherwise. You must return the goods without undue delay and no later than 14 days after notifying us of withdrawal. You bear the direct cost of returning goods. We may withhold reimbursement until we receive the goods back or proof of return.
Exceptions: The right of withdrawal does not apply to:
- supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (e.g., certain devotional items);
- supply of digital content not supplied on a tangible medium if performance has begun with your prior express consent and acknowledgment that you lose the right of withdrawal.

3.5. For defective, damaged, or non-conforming Products, contact us at store@sacratissimum.com. We will liaise with the Supplier on your behalf where possible, but ultimate resolution depends on the Supplier's policies and your applicable statutory rights.
4. Intellectual Property
All content on the Website (text, images, graphics, logos, audio, video, design, software) is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content for commercial purposes without our prior written consent.
5. User Conduct
You agree not to:
- use the Website for unlawful purposes;
- interfere with the Website's operation;
- attempt unauthorized access;
- post harmful, offensive, or infringing content (if comment/review features exist);
- use automated systems (bots, scrapers) without permission.
6. Limitation of Liability
To the maximum extent permitted by applicable law:
The Website, Products, and all related services are provided on an "as is" and "as available" basis without warranties of any kind (express or implied), including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy of Product information, or uninterrupted/secure operation.
We expressly disclaim any responsibility or liability for: (i) the quality, safety, authenticity, origin, description, or condition of any Product; (ii) any acts, omissions, delays, errors, breaches, negligence, or misconduct by Suppliers, manufacturers, carriers, or other third parties; (iii) any failure by a Supplier to fulfill an order; (iv) any customs, import, tax, or regulatory issues; (v) any damage, loss, or injury arising from use of the Products.
We shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages (including lost profits, data, goodwill, business interruption, or personal injury), even if advised of the possibility.
Our total aggregate liability arising out of or related to these Terms or your use of the Website/Products shall not exceed the amount you actually paid us for the specific Product(s) giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any matter that cannot lawfully be excluded under applicable law (including mandatory consumer protection rules).
7. Privacy
Your personal data is processed in accordance with our Privacy Policy Page, which forms part of these Terms.
8. Force Majeure
We are not liable for delays or failure to perform caused by events beyond our reasonable control (strikes, natural disasters, war, pandemics, supply chain disruptions, etc.).
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of The United States of America (USA) without regard to conflict of law principles.
Any disputes shall be submitted to the exclusive jurisdiction of the courts of California, USA.
If you are a consumer in the EU, you may also use the ODR platform for out-of-court dispute resolution.
10. Changes to Terms
We may update these Terms at any time. The updated version will be posted on the Website with a revised "Effective Date". Continued use after changes constitutes acceptance.
